Sentek Two Year Warranty

SENTEK PTY LTD (ABN 78 007 916 672) TRADING AS SENTEK of 77 Magill Road Stepney SA 5069 ("Manufacturer")
(“Distributor”)
(“Product”)
The Manufacturer and the Distributor hereby warrant to the original purchaser of
the Product that, for the term described in clause 1 below, the Product will be
free, under normal use and maintenance, from defects in material and workmanship,
subject to the following terms and conditions:

Term
This warranty shall exist for a period of twenty four (24) months commencing on the
date of the retail sale of the Product to the original purchaser.:

2.

Warranty
Unless otherwise stated in this document, the Manufacturer and/or the Distributor shall
at its discretion replace, repair or refund the purchase price of any Product that is
defective in material or workmanship within the warranty term set out in clause 1, without
charge to the original purchaser. Where payment in full for the Product has not been
received, the Manufacturer and/or the Distributor will only carry out such work upon cash
pre-payment for any such work, or refund only that portion of the purchase price that has
actually been received.

Other Warranty
Subject to any terms implied by law, this warranty contains the whole of the Manufacturer's
and/or Distributor's obligations and the Distributor (including its agents, officers and
employees) is not authorised to vary or extend the terms of the warranty. This warranty does
not exclude any conditions or warranties implied by applicable legislation conferring rights
upon consumers.

Limitations
This warranty shall not apply to, or include, any of the following:

A
|
Any defect or failure due to accident, misuse, abuse, movement of the Product
to a new site, negligence, non-observance of operating instructions or local
regulations on the part of any user, choice of location, improper installation,
configuration or connection, or faulty power supply.
|
|
B
|
If the Product has been repaired or serviced by a person not authorised by the
Manufacturer or Distributor to do so, or if non-approved parts have been fitted.
|
|
C
|
Failure to obtain proper maintenance.
|
|
D
|
If the Product is used other than for any reasonable purpose for which it was
manufactured, or is used in a way not specified by the Manufacturer.
|
|
E
|
If the original purchaser sells, leases or otherwise parts with possession of the Product.
|
|
F
|
Deterioration due to normal use and exposure, including abnormal environmental
conditions such as lightning strike, flood and extreme heat.
|
|
G
|
Expenses relating to transportation of the Product to and from
the Distributor and from the Distributor to the Manufacturer.
|
|
H
|
Any damage, indirect or incidental, of whatever nature.
|
5.
|
Limitation of Warranty: Liability & Remedy
|
|
A
|
The Manufacturer and the Distributor are not liable for any consequential,
indirect or accidental loss or damage or for any service not expressly provided
herein and the liability of the Manufacturer or the Distributor under this
warranty is limited to the repair or replacement of defective material or
workmanship by an authorised installer either on site or at its place of business.
Subject to clause 3, the Manufacturer and Distributor are hereby excluded
to the maximum extent permitted by law from all other liability in respect of the
Product.

While the Manufacturer and the Distributor warrant, where applicable, that the disk
on which all software is furnished is free from defects in materials and workmanship
under normal use, and free from virus at the time of delivery, the Manufacturer and
the Distributor do not warrant that the functions contained in the said software
program will meet any specific requirements or that the operations of the program
will be uninterrupted or error-free.

6.

Owner's Responsibilities

A
|
Maintenance of the Product is the responsibility of the owner. The owner must
retain evidence that proper maintenance has been performed on the Product by
the Manufacturer, the Distributor or an authorised installer. Claims made
during the warranty term will not be accepted if resulting from lack of maintenance
rather than faulty material or workmanship.

B
|
The owner must operate the Product in accordance with all instructions given
by the Manufacturer and/or the Distributor.
|
|
C
|
Upon discovery of a fault the owner must inform the Distributor as soon as
possible and arrange an on-site inspection by an authorised installer.
Wherever possible the fault will be rectified on-site. Where the Product must
be removed, this must be done by an authorised installer to ensure that the
warranty remains valid.

|
D
|
In the event that no response is received by the owner from the Distributor
within Twenty Four (24) hours, the owner shall immediately notify the Manufacturer.
